These general Terms and Conditions apply to customer ('Customer') orders of foreign currency and travellers cheques on the FOREX Web Shop (www.forexvaluta.dk), which is owned and operated by FOREX Valutaveksling A/S, Hovedbanegården 22, 1577 Copenhagen V, Denmark, Company Registration No. 17832190 (hereafter called 'FOREX'). Upon placing an order, the Customer accepts these Terms and Conditions between the Customer and FOREX.
Any modifications to these Terms and Conditions are only valid if FOREX has accepted the modifications in writing. If a discrepancy should arise between these Terms and Conditions and another agreement between FOREX and the Customer, these terms and conditions shall apply unless otherwise agreed in writing.
The products covered by this agreement are foreign currency and travellers cheques. The Customer may not choose any currency other than those offered by FOREX.
3 RATES AND LIMITATION ON AMOUNT
FOREX sells foreign currency at the exchange rate posted on www.forexvaluta.dk at the time the Customer places a final order with FOREX. The rate offered to the Customer before the Customer places a final order with FOREX is only valid as long as the exchange rate posted on www.forexvaluta.dk has not changed.
The purchase is not subject to special charges or fees if the foreign currency is picked up in a FOREX store. The standard insurance fee of 1.95% of the total amount in DKK is required for the purchase of travellers cheques. For delivery by registered mail, Post Danmark's fees of between DKK 88 and DKK 119.75 will be added to the purchase amount, depending on the value of the specific mailing. FOREX is not responsible for charges associated with payments made via an Internet banking agreement (see Clause 4 below), and any such charges must be paid by the Customer or the Customer's bank.
The maximum amount for any purchase is DKK 25,000. Several transactions and transactions for different foreign currencies may be carried out within this limit, however, for cash as well as travellers cheques.
Payment for purchases made through the FOREX Web Shop may only be made on the Internet via Danske Bank, Nordea or BG Bank. Therefore, the Customer must have an Internet banking agreement with one of the aforementioned banks.
Foreign currency and travellers' cheques may be collected from the FOREX branch selected at the time of purchase during that store's normal business hours. Foreign currency and travellers cheques are ready for collection within two working days after purchase. However, foreign currency and travellers' cheques are often available for collection sooner. Depending on the method of communication selected, an email or a text message will be sent to the customer when the order is ready for collection. Valid photo identification and an order number must be presented for collection. Only the person who placed the order is eligible to pick up the order.
Orders may also be delivered by mail. This option is only available for currency and travellers' cheque orders, which will be sent from FOREX within three working days after purchase. Orders may not be sent to addresses outside of Denmark. FOREX Global Cash orders can only be collected in person from the selected branch.
6 UNCLAIMED FOREIGN CURRENCY OR TRAVELLERS CHEQUES
Foreign currency or travellers cheques ordered for pick-up at a FOREX store will remain available for pick-up for ten days after the order is placed. If the order is not picked up at the end of the ten-day period, FOREX may sell the foreign currency or travellers cheques to another party. If the Customer would still like the order, FOREX must be given a reasonable amount of time to obtain the foreign currency or travellers cheques.
7 UNAVAILABLE FOREIGN CURRENCY
If FOREX cannot obtain the foreign currency ordered within the period stipulated, FOREX will contact the Customer to arrange the next course of action. If FOREX cannot contact the Customer, the payment will be returned in DKK.
8 RIGHT TO ANNUL THE AGREEMENT
FOREX does not offer the right to annul the agreement. FOREX may, however, buy back the foreign currency at the valid exchange rate at the time of the buy-back.
9 LIMITATION OF LIABILITY
FOREX assumes no liability for any direct or indirect loss to the Customer related to faulty, late, or missing delivery of the order, or fulfilment of the agreement with the Customer in general, unless otherwise required by law. In no event may FOREX's potential liability for damages exceed the amount of the order. Under no circumstances may FOREX be held liable for the Customer's loss of any kind in relation to the accessibility and operation of www.forexvaluta.dk or its supporting databases, including unauthorised intrusions into the databases by a third party (hacker) as well as any error or crash in the telecommunications network, unless FOREX has demonstrated gross negligence.
10 FORCE MAJEURE - LIABILITY FOR EVENTS BEYOND FOREX' CONTROL
If FOREX is unable to deliver an order of foreign currency or travellers cheques as agreed due to circumstances caused by delivery failure, strike, lockout, or other circumstances that cannot be attributed to FOREX or its subcontractors, or force majeure in general, then FOREX's commitments shall be suspended during said period and nondelivery during the period shall not constitute a breach of the agreement.
11 CHOICE OF LAW AND VENUE
Any disputes stemming from this agreement shall be adjudicated in accordance with Danish law with the Copenhagen Municipal Court as the choice of venue unless otherwise prescribed by law.
